Fourth Circuit • 2024

Lyons v. PNC Bank, N.A.

Published Fourth Circuit decision arising from Truth in Lending Act litigation and reflecting the firm’s continuing appellate work in complex consumer-finance disputes.

Ninth Circuit • 2023

Brown v. Transworld Systems, Inc.

Published Ninth Circuit decision in consumer litigation. The case is representative of the firm’s national appellate practice.

Supreme Court of Maryland • 2021

Nationstar Mortgage LLC v. Kemp

Significant Maryland appellate decision involving mortgage and foreclosure issues.

Wisconsin Court of Appeals • 2019

Harwood v. Wheaton Franciscan Services, Inc.

Successful published appeal and one of the early appellate decisions applying Wisconsin’s revised class action framework.

U.S. District Court for the District of Maryland • 2019

Jackson v. Sagal

Successful published federal decision arising from consumer protection litigation.

District of Maryland / Bankruptcy Court • 2008

Eyler v. 3 Vista Court LLC

In an important foreclosure-rescue matter, the district court agreed that a RICO claim based on collection of unlawful debt does not require proof of a pattern. On remand, the bankruptcy court found PHIFA and TILA violations, concluded that the conduct constituted collection of unlawful debt under RICO, and recommended treble damages and attorney’s fees.

Influential Litigation & Law Reform

Supreme Court of Maryland • 2008

Griffin v. Bierman

Although the Court ultimately upheld Maryland’s then-existing foreclosure notice system, the case highlighted serious policy concerns during the foreclosure crisis. The Court expressly noted that the Executive and Legislative Branches were considering substantial foreclosure reforms at the same time. Scott C. Borison was counsel for the homeowner on appeal.

Supreme Court of Maryland • 2008

Poku v. Friedman

The appeal was dismissed as moot because the homeowner had not posted a supersedeas bond. The litigation nevertheless highlighted significant foreclosure and procedural issues. The General Assembly later introduced the “Richard Atta Poku Foreclosure Defense Act,” addressing foreclosure appeal and bond issues. Scott C. Borison was counsel for the homeowner.

Maryland litigation • 2007

Bellinger v. Sydnor

Early PHIFA litigation in which the defendants raised a constitutional challenge to the statute. Scott C. Borison was involved in the case during the formative period of PHIFA enforcement.
