Scott C. Borison has tried cases before both judges and juries. The matters below illustrate significant trial-level outcomes.
Huizar v. Horizon Bank
Scott served as co-counsel in a Fair Credit Reporting Act jury trial against Horizon Bank. The jury awarded substantial compensatory and punitive damages.
Result: $2,865,000 jury verdict — $365,000 compensatory and $2.5 million punitive damages.
Parsons
Scott represented homeowners in litigation arising from a foreclosure-rescue transaction under Maryland’s Protection of Homeowners in Foreclosure Act. The matter resulted in a significant judgment and is representative of the firm’s early PHIFA trial work.
Result: $1,062,324 judgment in favor of the homeowners.
Ray v. Citifinancial
Scott represented homeowners in litigation arising from a second mortgage. At trial the Bankruptcy Court eliminated a second mortgage lien and on appeal it was established that in a bankruptcy proceeding the Bankruptcy Court could order rescission without requiring any tender.
Eyler v. 3 Vista Court LLC
The litigation produced findings that the homeowners were stripped of substantial equity, that PHIFA applied, that the transaction could be rescinded, and that TILA and RICO remedies were available.
